1. Who you are contracting with

The UseBullion website and platform (the "Service") are operated by UseBullion Trading Technologies ("UseBullion", "we", "us", "our"), trading as "UseBullion". By creating an account or using the Service you are entering into a binding agreement with UseBullion Trading Technologies on these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You confirm that you have authority to enter into these Terms (on your own behalf, or on behalf of an organisation you represent), that you are at least 18 years old, and that you are legally able to enter contracts in your jurisdiction.

2. The Service

UseBullion is risk-management software for gold traders. The subscription provides a pre-trade check API, server-side enforcement of limits you configure, a kill-switch, a position-sizing calculator, a trade journal, and a cryptographically signed audit log. UseBullion does not hold, manage, custody, or have access to your funds. Your capital remains exclusively in your own regulated brokerage account at all times.

UseBullion is not a broker, dealer, investment adviser, asset manager, or custodian. We do not sell trading signals or recommendations, do not manage accounts, do not accept deposits, process withdrawals, or pool client funds, and we never place orders. You decide and send every order yourself. Nothing on UseBullion constitutes personalised investment advice.

3. Your brokerage account

You are solely responsible for opening, maintaining, and funding your brokerage account with a regulated broker of your choice. UseBullion has no control over your broker's execution, fees, slippage, or operational availability.

4. Payments — seller of record and payment processor

UseBullion Trading Technologies is the seller of record for all paid subscriptions and appears as the merchant on your invoice. Card, bank transfer, and local payment methods are processed by Flutterwave, a licensed payment service provider acting on our behalf. UseBullion never sees or stores your full payment card number.

By purchasing a paid plan you also agree to Flutterwave's Terms of Use and Privacy Policy for the payment transaction itself. Any taxes required in your jurisdiction are your responsibility unless stated otherwise at checkout.

5. Subscriptions, billing and renewals

Paid plans are billed in advance on a recurring basis (monthly or annual, as selected at checkout) in US Dollars, and renew automatically at the then-current price until cancelled. You may cancel at any time from Settings, or by emailing hello@usebullion.com; cancellation stops future renewals and takes effect at the end of the current billing period.

6. Acceptable use

You must not:

Use the Service for anything unlawful, fraudulent, or abusive.
Send spam, malware, or otherwise interfere with the Service or other users.
Probe, scan, scrape, or attempt to bypass security or rate limits.
Reverse engineer, decompile, or attempt to derive our source code, algorithms, or models.
Resell, redistribute, or sublicense analytics, API responses, or platform access, or repackage them as a signal, advisory, or managed-account product.
Infringe any intellectual property, privacy, or other rights of third parties.
Use the Service in a way that violates applicable financial or trading regulations.

7. Intellectual property

The Service, including its software, source code, models, risk engine, algorithms, analytics, documentation, UI, logos, and the "UseBullion" name and branding, is owned by UseBullion Trading Technologies (or licensed to us) and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms and your subscription. All rights not expressly granted are reserved. You retain ownership of the content and data you submit; you grant us a limited licence to host and process it solely to operate and improve the Service.

8. No financial advice

Nothing on UseBullion is personalised investment, legal, tax, or financial advice, and nothing we output is a recommendation to buy or sell. Risk decisions and macro context are informational inputs to your own decisions and may be incomplete or wrong. You are solely responsible for your trading decisions and outcomes. Past performance is not indicative of future results.

9. Service availability and disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that prechecks or killswitches will always execute on time.

10. Suspension and termination

We may suspend or terminate your access, with or without notice, if you materially breach these Terms, fail to pay amounts due, create security or fraud risk, or repeatedly violate acceptable use. You may terminate at any time by cancelling your subscription and closing your account.

11. Limitation of liability

To the maximum extent permitted by law, UseBullion Trading Technologies and its affiliates are not liable for trading losses, missed gains, execution failures at your broker, or any indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the fees you paid to us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (for example, fraud or death and personal injury caused by negligence).

12. Indemnity

You agree to indemnify and hold UseBullion Trading Technologies harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful use of the Service, or your violation of third-party rights.

13. Changes

We may update these Terms. Material changes will be communicated by email or in-app notification and take effect on the date stated in the notice.
